The claim that a judicial coup is underway is a characterization used by President Trump’s allies and administration officials to describe unfavorable court rulings 2 8 10. Deputy Chief of Staff Stephen Miller, former Speaker Newt Gingrich, and Elon Musk have all publicly described judicial actions blocking presidential orders as a judicial coup or tyranny of the judiciary 2 4 8. The White House specifically applied this label to a U.S. Court of International Trade decision regarding tariffs 3. Conversely, legal watchdogs and advocacy groups such as Citizens for Responsibility and Ethics in Washington (CREW) argue that this terminology is explosive rhetoric used to target judges and delegitimize the judicial branch’s constitutional role 10. Some analysts contend that the actual threat to constitutional norms stems from executive efforts to bypass the law or retaliate against career staff and the courts 5 7 9. Because the term coup is used as a political descriptor for standard judicial review, there is no objective evidence of an illegal seizure of power 10. Readers are encouraged to review the CREW analysis 10 and the Brennan Center report 7 to judge the credibility of these competing characterizations for themselves.
